Is SPRAVATO® Federally Legal?

If you have been researching treatment options for depression, you have probably come across SPRAVATO® at some point. You may have also noticed that it is related to ketamine, and that can raise a natural question. Is SPRAVATO® actually legal? It is a fair thing to wonder, especially with so much conflicting information floating around online about ketamine clinics and their legal status. Between news stories about unregulated ketamine businesses and the general stigma around anything connected to it, it makes sense that people want a straight answer before they consider treatment for themselves or a loved one.

What Is SPRAVATO®?

SPRAVATO® is the brand name for esketamine, a nasal spray approved by the FDA to treat depression in adults who have not responded to other antidepressants. It was approved in 2019 for treatment resistant depression, and later approved for adults with major depressive disorder who are also experiencing suicidal thoughts. Esketamine is derived from ketamine, but it has been studied, tested, and cleared through the same rigorous FDA approval process as any other prescription medication.

Where Does the Legal Confusion Come From?

Most of the confusion comes from ketamine's reputation. Ketamine itself has a long history as an anesthetic, and it is sometimes used recreationally outside of medical settings, which is illegal. Because SPRAVATO® is a close relative of ketamine, people sometimes assume the two are treated the same way under the law. SPRAVATO® is classified by the DEA as a Schedule III controlled substance, which means it does carry some risk of misuse, similar to other prescription medications in that category. That classification is exactly why it comes with strict rules for how it can be prescribed and used, and it is also why you will never see SPRAVATO® sold over the counter or through an online pharmacy.

Is SPRAVATO® Actually Legal to Use?

Yes, SPRAVATO® is completely legal when it is prescribed and administered the right way. Because of its Schedule III status, the FDA requires every provider who offers SPRAVATO® to be part of a program called a Risk Evaluation and Mitigation Strategy, or REMS for short. This program exists to keep patients safe. It means you cannot pick up SPRAVATO® at a regular pharmacy and take it home. Instead, you receive the nasal spray in person at a certified clinic, under the direct supervision of a trained provider, and you stay on site for monitoring afterward. This is very different from unregulated ketamine clinics that sometimes operate with far less oversight.
